The agreement
These Terms of Use form a binding agreement between you and Emma Sanders ("we", "us", "the studio"), publisher of the Sidapa Pendant mobile application. They cover both the app itself and any commission you place through it.
Our Privacy Policy is incorporated by reference and forms part of this agreement.
Eligibility
You must be at least 18 years old, or the age of legal majority where you live, to submit a Commission Slip. Browsing motifs, reading Motif Lore, and following the Carving Wall are available to anyone permitted to use the app under the applicable app store's rules.
Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Sidapa Pendant on devices you own or control, for your own non-commercial use. You may not:
- copy, sell, sublicense, or redistribute the app;
- reverse engineer, decompile, or attempt to extract source code except where law expressly permits;
- remove or obscure any notice of ownership;
- use the app to build a competing product or to scrape motif, lore, or stage-image content in bulk.
Commissions and the Carve Queue
Submitting a Commission Slip is an offer, not a completed contract. A binding order exists only when we accept it — shown in the app when your slip enters the Carve Queue and a confirmation is sent to your email.
We may decline or refund a slip before carving begins, for example if a requested blank is unavailable, the design cannot be executed in the chosen grain, or the request is outside what the studio takes on.
Once carving has physically begun on your blank, the commission cannot be cancelled or altered, because the material has been committed to your design.
Handmade variation
Every pendant is cut by hand from a natural material. You accept that:
- grain, tone, density, and surface character differ between blanks and cannot be matched exactly;
- the finished piece will differ in small ways from Silhouette Set previews, Motif Detail renderings, and Stage Walk frames;
- shadow depth under a relief depends on the actual bone and the carver's judgement at the bench;
- colour on your screen is not a colour guarantee.
These variations are the nature of the work, not defects.
Materials and import rules
We work in legally and ethically sourced bone from livestock, and we do not carve protected, endangered, or restricted wildlife material. On request we will tell you the material used in your piece.
Prices, payment and shipping
Prices are shown in the app before you confirm a slip and may change for future commissions without affecting one already accepted. Payment is processed by the applicable app store or an external payment provider under their own terms; we never handle your card details.
Cord Fitting selections may affect the total. Risk of loss passes to you on delivery to the address on your Commission Slip. Slip Sent marks the point at which the piece has left the studio; tracking, where available, is provided by the carrier.
Cancellation, returns and remakes
A commission is made to your specification, so statutory cooling-off rights for custom goods may not apply once work begins. Before your slip enters carving, you may cancel for a full refund by writing to us.
If something is wrong
If a piece arrives damaged, or materially differs from the accepted commission, contact us within 14 days of delivery with photographs. We will repair, remake, or refund at our discretion, and cover return shipping where the fault is ours. Damage from wear, drops, moisture, or alteration after delivery is not covered. Nothing here limits rights you have under mandatory consumer law.
Your content and the Carving Wall
You keep ownership of what you write and upload — slip instructions, reference images, display names, and Note Detail reflections. By submitting content you grant us a limited licence to use it for the purpose of fulfilling and supporting your commission.
If you choose to make your commission visible on the Carving Wall, you additionally allow us to display the piece and its stage imagery to other users of the app. You may withdraw it at any time. Your private Note Detail reflections are never published.
You confirm you have the right to any reference image you upload and that it does not infringe anyone else's rights.
Our content and motif lore
The app, its interface, the Relief Motifs catalogue, Motif Lore texts, bench notes, and all Carve Bench and Stage Walk imagery are owned by the studio or its licensors and protected by copyright. You may keep and share images of your own pendant freely. You may not reproduce the motif catalogue or lore texts commercially, or use our stage imagery to advertise another maker's work.
Motif Lore is offered as cultural and design background, in good faith. It is descriptive, not authoritative scholarship, and carries no claim of endorsement by any community.
Acceptable use
When using the app, including anything visible on the Carving Wall or written on a slip, you agree not to:
- request or post hateful, harassing, threatening, obscene, or unlawful content;
- impersonate another person or misrepresent your connection to the studio;
- request a design that infringes a trademark, copyright, or protected symbol;
- interfere with, probe, or overload the app or its services;
- use automated means to collect content or place slips.
We may remove wall entries and refuse commissions that breach this clause.
Availability and changes
The app is provided as an ongoing service and may be updated, changed, suspended for maintenance, or discontinued. We will give reasonable notice before discontinuing it and, where practical, allow you to export your Keepsake Case first. Motifs, blanks, and cord fittings may be added or withdrawn at any time.
We may amend these terms; the effective date above will change and material amendments will be announced in the app. Continued use after that date means you accept the revised terms. Commissions already accepted remain governed by the terms in force when we accepted them.
Disclaimers
A pendant is a decorative object. It is not protective equipment, and no claim of spiritual, medical, or protective effect is made or implied by any motif or its lore.
Limitation of liability
Some jurisdictions do not allow certain exclusions, so parts of this clause may not apply to you. Nothing here excludes liability for death or personal injury caused by our negligence, or for fraud.
Termination
You may stop using the app at any time by deleting it; doing so erases on-device data including your Keepsake Case, so export anything you want to keep first. We may suspend or terminate your access if you materially breach these terms. Clauses on content ownership, disclaimers, liability, and governing law survive termination. Termination does not cancel a commission already in the Carve Queue unless we say so in writing.
App store terms
If you obtained the app from the Apple App Store or Google Play, that store's terms also apply. This agreement is between you and us, not the store. The store is not responsible for the app, its content, maintenance, support, or any claim relating to it, but may enforce these terms as a third-party beneficiary. You confirm you are not located in a country subject to a relevant embargo and are not on a prohibited-party list.
Governing law
These terms are governed by the laws of the publisher's place of business, without regard to conflict-of-law rules, and disputes will be heard by the courts there. If you are a consumer, you keep the protection of mandatory laws of your country of residence and may bring proceedings in your local courts where the law allows.
General
If a provision is found unenforceable, the rest remains in force. Our failure to enforce a term is not a waiver of it. You may not assign this agreement; we may assign it as part of a transfer of the studio, with notice. These terms, together with the Privacy Policy, are the entire agreement between us about the app.
